This page (and any other documents that are referred to on it) contains the Terms and Conditions on which we supply any of the products listed on our website www.fora.pt ("our website") to you.

Please read these Terms and Conditions carefully before ordering any products from our website. You should be aware that by ordering any of our products, you agree to be bound by these Terms and Conditions (hereafter referred to as "T&C's"). If you have any questions or feel unsure about any of the content please contact Customer Service Team before placing an order via email: orders@fora.pt. Print these Terms & Conditions and keep a copy of them for your reference.
We have written these T&C’s with the consumer in mind and have tried to make them as easy to understand as possible. To further enhance your understanding of the terms we have listed some words that are widely used throughout the document.

Here’s the terminology:
Contract - means any purchase of items from our site between us and you for which these T&C’s are used for.
Conditions - means the standard T&C’s of the sale, including the Returns Policy and any special terms and conditions confirmed in writing by us.
Goods - means the products or services which we have sold to you in accordance with our T&C’s. We – means FORA, and “us” and “our” shall hold the same meaning.

Within these T&C’s we shall use headings to aid your understanding of the document.

 


FORA designs, makes and sells handcrafted eyewear and sunglasses online.

If you have any questions, queries or concerns no matter how big or small we’ll give you the best advice we possibly can. Please contact our support team via e-mail at info@fora.pt We aim to respond to all e-mail queries within 24 hours, Monday through Friday.

Any transaction you enter into with us through our official website (fora.pt) is entered into with FORA, our legal entity which owns the FORA brand, and owns and operates this website. Our official company details are:

Accessing our website means that you automatically agree to our Terms and Conditions. If you do not agree with any of these, we would advise you to discontinue the use of our site. Our website is provided to you for your personal use only.
These terms and conditions will apply to all usage and orders placed on this site. Customers accessing the website will be responsible for compliance with local legislation.

We have made every effort to display the products as accurately as possible but cannot guarantee that the product images you see displayed on your screen are a totally accurate representation of the actual merchandise due among other reasons to the technical difference in monitors or screens you may use.

By placing an order through our website, you confirm that you are legally capable of entering into binding contracts, that the personal information which you provide when you register as a customer and place an order is true, accurate, current and complete in all aspects, and that you do not impersonate any other person.

We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represent the full functionality, accuracy, and reliability of the website.

As part of our effort to make further improvements to our services we provide to our customers, telephone calls with and by us may be recorded or monitored. We also may monitor incoming and outgoing emails.

All specifications, drawings and particulars of weights, sizes and performance issued by us are approximate only.

 


By submitting your order to FORA you confirm:

You are aged 16 or over and you are not registered blind or partially sighted;

You are in possession of a written prescription for your spectacles (that includes your pupil distance for both eyes) that has been given to you by a suitably qualified person in the last 24 (twenty-four) months (or 12 (twelve) months if you are aged 70 or over);

Upon request, you will supply accurate details of your current prescription (including any notes on the prescription).


All prices shown in the website are in Euro's and inclusive of VAT at 23% or American Dollars. Where applicable, VAT may change from time to time.

 


The delivery cost will depend on the geographic location of your shipping details.

We accept Visa credit card, MasterCard credit card, debit card and PayPal. If you have a Portuguese bank account we also accept MB payments and Payshop. We take payment from your card at the time you place the order on our website.

All credit card and debit card holders are subject to validity checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

 

If an item sells out, we will take it off display as soon as possible. If items that you order should be out of stock, or delayed for any reason, we will try to contact you, or if we receive no response to our e-mail we will continue to process the remaining items of your order.


We have tried to make shopping with us as easy as possible. If you would like to place an order, you can do so in two ways. Firstly, you can register an account with us. You will then be given a unique personal log-in name and password combination by email. Your personal details will be stored behind your log-in name and password and can only be accessed and changed by you. As soon as you have a log-in name and a password, you can place your order.
If you wish to place an order, select the desired pair of glasses, including your chosen color and press the “Add to Cart" button. When you have finished shopping, click on the "Place Order" button. This starts the payment process. Check your details carefully and enter the address you want your order delivered to.

Once you have placed an order, it will then be confirmed by email. Please check your order and the confirmation thoroughly. It is important that you give a correct and personal email address when you register in order to avoid errors. Please make sure that your SPAM filter does not cause you to not receive our messages.

You are solely responsible for any abuse of your account such as when someone else places an order using your password. When placing an order, you have agreed that these Terms and Conditions apply to such order. If you suspect your account is being abused, please contact our Customer Service Team orders@fora.pt


When your order has been shipped we will send you a dispatch confirmation by email. This will include a track and trace code which will allow you to track your order.
We send the goods that you have ordered through GLS, FedEx, DHL or Batch depending on your location. The place of delivery is deemed to be the shipping/delivery address that you provide in your order. If you have provided us with the wrong address or would like to change it, please contact us within 24 hours of placing your order. Unfortunately, we are unable to change the delivery address after this period of time.

We aim to deliver your order within a maximum period of up to 6 business days however unfortunately; we are unable to guarantee this.

If you are not at home during the day our carrier will attempt a new delivery in the following day(s). They will also provide the option for a scheduled delivery time. It is important that you give the right address when placing the order. Please note it's not possible to have your order delivered to a P.O. Box.

If the goods are lost or damaged in transit, please let us know within 15 business days after, so that we can make a claim against the carrier. We will offer you the choice of a replacement or a full refund.

All FORA eyewear is warranted for twenty-four months (2 years) from the date of purchase against manufacturer defects. Coverage is valid only with the proof of purchase (original receipt) from FORA or from an authorized FORA dealer. Alteration of FORA products will void warranty. During the term of this warranty, FORA will repair or replace (if repair is not possible) any current style, which is deemed by FORA to possess a manufacturer’s defect. Scratched lenses or other wear and tear as a result of normal use are not covered by this warranty.

Certain conditions may invalidate warranty coverage including but not limited to:

• Excessive wear

• Visible scratches

• Warped acetate from exposure to extreme heat

• Any type of abuse or mistreatment

FORA bears the CE mark showing that complies with the essential safety requirements set by European Directive 89/686/EEC, subsequent revisions and meet the EN ISO 12312-1 standard.
For all our frames we use cellulose acetate. This high grade, natural material can be molded to fit your face and features, and will need to be adjusted for the best personal fit when needed. Please visit one of our FORA stores or an authorized dealer for these adjustments.

From normal wear, frames and lenses can accumulate dirt and dust. For a regular cleaning routine, please use a microfiber cleaning cloth and cleaning spray. Do not use solvents (e.g. alcohol or acetone) or aggressive detergents which may alter the features of the glasses.

To protect your glasses, store frames in a cool and dry place. Places with increased amounts of humidity can rust frame hardware. Avoid exposure to high temperatures such as the heat in a car without conditioning (e.g. car dashboard) because high temperatures may alter the features of the glasses. Replace the sun lenses if damaged (e.g. scratched lenses). Use only original accessories and spare parts.

For the best protection, please store eyewear in the case provided.


The sun lenses fitted in FORA frames are from ZEISS® and both sun lenses and optical lenses comply with all major international safety provisions featuring 100% protection against UVA/UVB, and are designed to protect against the sun and wind. These lenses feature high optical precision and are impact resistant according to EN ISO 12312-1 standard and ANSI Z80.3.

However, this eyewear is not suitable for:

1. Direct observation of the sun or for viewing solar eclipses.

2. Protection against artificial light sources (e.g. solaria).

3. Use as eye protection against mechanical impacts hazards, during which the sunglasses could break, causing face or eyes injuries.

4. Driving at night, twilight or under condition of dull light.

Sensitivity to light and glare especially in cases of bright sunlight and strong sun glare, such as on snowfields, at the beach or at sea, varies from one person to another, but it must be considered that the lightest filters categories 0 and 1, reduce solar radiation only slightly in the visual field whilst guaranteeing excellent protection in the UV area.

We use many different lens materials and coatings in our collection. Some lenses are polarized. Polarization is a film affixed in the lens to block glare from the sun. This does not increase the UV protection of the lenses.

For organic material lenses, please use a microfiber cloth and cleaning spray to remove dirt and dust. If you have a lens coating such as a mirror coating, please keep lenses dry as to not erode the coating. Do not expose your eyewear to harsh chemicals or detergents. Cleaning lenses with anything other than the provided microfiber cleaning cloth could result in scratches on the lenses.


We do our utmost to provide you with the best information, products and services possible. In the case you do have a complaint or other comment to make please contact us by email info@fora.pt
at the earliest possibility clearly explaining the feedback you have. We aim to reply to any customer complaints as soon as possible and within a maximum of 15 days.

Our liability for losses you suffer as a result of us breaking these Terms and Conditions is strictly limited to the purchase price of the product you purchased. In relation to our contractual obligations to supply the goods following acceptance of orders placed on our website; we will not be liable for any loss or damage whatsoever, in any way connected with your use of the website.


All purchases made on the website www.fora.pt are subject to Portuguese legislation. Regardless of where you access this site, you agree that any action at law or in equity arising out of or relating to these T&C’s shall be filed and adjudicated only to the Court District of Lisbon, Portugal, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding between you and the Company or any of its affiliates.


These Terms apply to our information and offer to you, the agreement between us and any related communication. Please be aware that we may change our Terms and Conditions at any time. By placing an order, you agree that the latest version of these Terms and Conditions will apply to this.
These terms were last changed in April 2023.

In the event of any of these Terms and Conditions to be invalid or unenforceable the remainder of these Terms and Conditions will remain in place. No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events outside our reasonable control. This may include changes to legislation, regulations or restrictions placed by government.

These Terms and Conditions and any document referred to in them represent entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party´s only remedy shall be for breach of contract as provided in these terms and conditions.
